Included in this Class Action are all persons who purchased or otherwise acquired the common stock of AvTel Communications, Inc. (now known as NetLojix Communications, Inc.) on November 12, 1998.

This case has been settled. The Claims Administrator for this litigation is Berdon Claims Administration LLC. The deadline for submitting a proof of claim was June 8, 2001.
